Terms of Service

Please read these terms carefully before using Off Record.

1. Acceptance of Terms

By downloading, installing, or using the Off Record mobile application ("App", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Off Record, Inc. ("Off Record", "we", "us", or "our"), a company incorporated in the United States.

We reserve the right to modify these Terms at any time. We will notify you of material changes via in-app notification or email. Your continued use of the Service after the effective date of changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use Off Record. By using the Service, you represent and warrant that:

You are at least 18 years old;
You have the legal capacity to enter into a binding agreement;
You are not prohibited from using the Service under applicable law;
You will use the Service only for lawful purposes and in accordance with these Terms.

3. Account Registration & Anonymity

3.1 Account Creation

To access certain features, you must create an account using a valid work email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Anonymity

Off Record is designed as an anonymous professional networking platform. Your identity is not publicly displayed to other users. However, anonymity does not exempt you from compliance with these Terms. We retain your email address for account management and may be required to disclose information under applicable law.

3.3 Account Security

You agree to notify us immediately of any unauthorized access to your account. Off Record is not liable for any loss or damage arising from your failure to protect your account credentials.

4. Acceptable Use

4.1 Permitted Uses

You may use Off Record to share professional experiences, review employers, benchmark salaries, participate in anonymous discussions, and network with other professionals in a lawful and respectful manner.

4.2 Prohibited Conduct

You agree not to:

Post content that is defamatory, harassing, threatening, abusive, or discriminatory;
Share false, misleading, or fraudulent information, including fake salary data;
Attempt to de-anonymize or identify other users without their consent;
Use the Service to solicit personal information from other users;
Scrape, crawl, or extract data from the Service by automated means;
Circumvent any access controls, rate limits, or security features;
Impersonate any person, company, or entity;
Use the Service to distribute spam, malware, or unsolicited commercial messages;
Post content that infringes any intellectual property or privacy rights;
Use the Service for any illegal purpose under Turkish law, EU law, or US law.

4.3 User-Generated Content

You retain ownership of the content you post ("User Content"). By posting User Content, you grant Off Record a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Service. You represent that you have all necessary rights to grant this license.

5. Salary & Professional Data

Off Record collects and displays aggregated, anonymized salary and compensation data contributed by users. This data is provided for informational purposes only and does not constitute professional financial or employment advice. Off Record does not verify the accuracy of user-submitted salary data and disclaims all liability for decisions made in reliance on such data.

Salary data is aggregated and displayed only when sufficient data points exist to prevent individual identification.

6. Advertising

Off Record is an ad-supported service. We may display third-party advertisements within the App. By using the Service, you consent to the display of advertisements. We are not responsible for the content of third-party advertisements. Advertisers may use cookies or similar tracking technologies subject to their own privacy policies. We do not sell your personally identifiable information to advertisers.

Ad targeting may use aggregated, non-personally identifiable professional context (e.g., industry, seniority level) to serve relevant ads. We do not share your email address, salary data, or identifiable information with advertisers.

7. Intellectual Property

The Service, including all software, designs, text, graphics, and other content created by Off Record (excluding User Content), is owned by or licensed to Off Record, Inc. and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

8. Termination

We reserve the right to suspend or terminate your account, at our sole discretion, if we reasonably believe you have violated these Terms. You may terminate your account at any time through the App settings. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. OFF RECORD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OFF RECORD, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the greatest extent permitted by law.

11. Governing Law & Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. To the extent that Turkish mandatory consumer protection laws apply to Turkish residents, such mandatory provisions are not excluded.

11.2 Turkish Users

Users residing in Turkey acknowledge that Turkish consumer protection legislation and personal data protection law (KVKK) may provide additional rights that cannot be waived by contract.

11.3 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration. Turkish users may alternatively submit disputes to the relevant Consumer Arbitration Committee or Turkish courts as permitted by Turkish law.
